1. SSDI Back Pay Taken for Child Support Arrears

   My husband of 27 years had an affair, produced a child (found out years later) Child Support was ordered in another state then lodged in our state, many $'s owed in arrears, child is 18 now (lives in another state Mom married recently) and SSDI back pay (2 years worth) is going to what looks to be an ATLAS number per a letter from SSA (it says court order but it is not a court case number.)

   I am the injured spouse, I have financially and physically taken care of him for 5 years of End Stage Kidney Failure and get nothing? Anything I can do? Payment has not been issued yet. And on top of that, we are separated, this is his old address but SSA sent the notification here instead of to his current address that they have on record.

   The obligation to his child comes before just about everything/anything else.

   I do feel your pain, but this is something he should have taken care of a long, long time ago.

   And exactly which part was unclear?

   You get nothing. It's not your money. The government can, and WILL, intercept SSDI backpay (and his regular SSDI can be garnished, too) if the recipient owes child support.

   Let me try again.

   Your husband's SSDI backpay can be intercepted in order to fulfill a child support obligation.

   His regular checks can also be garnished.

   Can My Disability Payments Be Garnished?
   Whether or not your disability payments can be garnished depends on which type of disability benefits you receive and whether or not your child support payments are current. SSI (Supplemental Security Income) disability payments are made to people who have a very low income. These payments cannot be garnished for child support payments. SSDI (Social Security Disability Insurance) payments, however, can be garnished to fulfill child support obligations.

   Can My Back Pay Be Garnished?
   If you are entitled to a lump sum of back pay and you owe past-due child support, your back pay can be garnished to satisfy this debt. While your entire back payment will not be taken from you, a percentage of it may be garnished in order to fulfill your child support obligation.
